Terms of Service

1. Acceptance

By using Prisma or joining the Prisma waitlist, you agree to these Terms of Service. You must be at least 18 years old. If you use Prisma on behalf of an agency or company, you represent that you are authorized to bind it to these Terms.

2. The Service

Prisma is a web-based social media publishing tool for freelancers, agencies, and creators: you compose a post once, and Prisma adapts it to each connected social network, routes it through your client's approval when you want one, and publishes it on schedule. Plans, pricing, and the features each plan includes are shown in the app and form part of these Terms.

3. Your Accounts and Connected Networks

You are responsible for the social media accounts you connect and for your activity under them. Connecting an account confirms you are authorized to publish to it. Each network's own terms of service continue to apply to everything Prisma publishes or sends there on your behalf.

Your use of a connected network through Prisma is also governed by that network's terms. For Facebook, Instagram, and Threads, that includes Meta's Terms of Service and the Meta Platform Terms that govern Prisma's access to Meta's APIs. For TikTok, that includes the TikTok Terms of Service. The same applies to every other network you connect. If these Terms and a network's terms conflict on how that network may be used, the network's terms prevail for that network.

4. Acceptable Use

You agree not to use Prisma to:

We may suspend publishing or terminate accounts that put the platform or its users at risk.

5. Your Content

You retain all rights to the content you create in Prisma. You grant us a limited license to store, process, adapt, and transmit that content solely to provide the service, including sending drafts to our AI provider when you ask for caption assistance and delivering posts to the networks you choose. We claim no ownership over your content and do not use it for advertising.

6. Subscriptions and Billing

Paid plans are processed by Stripe, Inc. and billed on a recurring basis. Pricing, trial terms, and renewal are shown in the app before any charge. You can cancel at any time from Settings, under Billing and plan.

7. Disclaimers and Limitation of Liability

The service is provided "AS IS" without warranty of any kind. We do not guarantee that the service will be uninterrupted or error-free, or that any network will accept, display, or keep any post (networks change their APIs and policies outside our control). To the maximum extent permitted by law, our total liability for any claim arising from your use of Prisma is limited to the greater of (a) the amounts you paid us in the 12 months preceding the claim, or (b) $50.00 USD. We are not liable for indirect, incidental, punitive, or consequential damages, including lost profits or lost audience.

8. Termination

We may suspend or terminate your account for material breach of these Terms, non-payment, or if required by law. You may cancel at any time, and you may ask us to delete your account by writing to support@prisma.onl. Upon termination, your data is handled as described in our Privacy Policy.

9. Governing Law and Venue

These Terms are governed by the laws of the State of Texas and applicable federal law of the United States, without regard to conflict-of-law principles. The exclusive venue for any dispute shall be the state or federal courts of Bexar County, Texas.

10. Changes to These Terms

We may update these Terms. If we make a material change, we will notify registered users by email at least 30 days before it takes effect. Continued use after the effective date constitutes acceptance.
